  • Product descriptions
  • Videos
  • Designs protected by copyright
  • Website content
  • Other original creative works protected by applicable copyright law

Claims involving trademarks, patents, trade dress, or other intellectual property rights may also be reported through our Intellectual Property Claim Policy.

3. Who May Submit a Copyright Notice

A copyright infringement notification should be submitted by:

  • The copyright owner; or
  • A person legally authorized to act on behalf of the copyright owner.

If you submit a notice as a representative, you must have authority to act for the copyright owner.

We may request reasonable information confirming that authority.

4. How to Submit a Copyright Infringement Notice

Copyright notices concerning material appearing on noyve.com may be submitted to:

Noyve – Copyright Contact

Email: support@noyve.com

Address: 8 Haviland St Apt D, Norwalk, CT 06854-3026, United States

Recommended email subject:

A. Signature

A physical or electronic signature of the copyright owner or a person authorized to act on the copyright owner's behalf.

B. Identification of the Copyrighted Work

Identify the copyrighted work that you claim has been infringed.

If multiple copyrighted works on the website are covered by one notice, you may provide a representative list of those works where permitted by law.

C. Identification of the Allegedly Infringing Material

Identify the material that you believe infringes the copyrighted work.

Please provide information reasonably sufficient for us to locate the material, such as:

  • Exact webpage URL
  • Product page URL
  • Product name
  • Image URL where available
  • Screenshot
  • Description of the material
  • Location of the content on the website

D. Your Contact Information

Provide information reasonably sufficient for us to contact you, including:

  • Full name
  • Mailing address
  • Telephone number, where available
  • Email address

E. Good-Faith Statement

Include a statement that you have a good-faith belief that the use of the material in the manner complained of is not authorized by:

  • The copyright owner;
  • The copyright owner's agent; or
  • Applicable law.

F. Accuracy and Authority Statement

Include a statement that:

  • The information in your notification is accurate; and
  • Under penalty of perjury, you are the copyright owner or are authorized to act on behalf of the copyright owner.

6. Recommended DMCA Notice Format

[Telephone number]

[URL or other supporting information]

Reported Noyve URL:

[Exact URL containing the allegedly infringing material]

Description of Infringement:

Useful supporting information may include:

  • Title of the work
  • Author or creator
  • Original publication date
  • Original publication URL
  • Copyright registration number, if applicable
  • Original files or photographs
  • Other information demonstrating ownership

A copyright registration number is helpful when available but should not be represented as mandatory for submitting a notice where applicable law does not require one.

8. Identifying the Reported Material

Please identify the allegedly infringing material specifically.

For example, instead of stating: “Your website uses my pictures,” identify:

  • The exact product page.
  • The particular photograph.
  • The location where the photograph appears.

Specific information allows us to investigate claims more efficiently.

9. Incomplete Notices

A notice that does not include enough information to identify:

  • The copyrighted work;
  • The allegedly infringing material; or
  • The person submitting the notice

may delay our ability to review the claim.

Where appropriate, we may contact the sender to request additional information necessary to evaluate the notice.

10. Review of Copyright Notices

When we receive a sufficiently complete copyright infringement notification, we may:

  • Review the notice.
  • Locate the reported material.
  • Evaluate the information provided.
  • Request additional information if necessary.
  • Remove or disable access to material where appropriate.
  • Notify the party responsible for affected material where applicable.
  • Take other appropriate action consistent with applicable law.

We aim to respond to valid copyright concerns appropriately and without unnecessary delay.

11. Removal or Restriction of Material

Where a sufficiently supported notice indicates that material may infringe copyright, Noyve may:

  • Remove the material.
  • Disable access to the material.
  • Remove an image.
  • Modify or remove a product listing.
  • Remove written content.
  • Temporarily restrict content while a claim is reviewed.
  • Take other reasonable action.

Submission of a notice does not automatically establish copyright infringement.

12. Notice to the Affected Party

Where applicable, if content is removed or access is disabled in response to a copyright notification, we may notify the person or party responsible for the affected material.

The notification may include sufficient information to allow that party to understand the reason for the action and, where legally appropriate, submit a counter-notification.

13. Counter-Notification

If material you provided has been removed or disabled because of a copyright notice and you believe the removal resulted from mistake or misidentification, you may submit a counter-notification.

Counter-notifications should be sent to:

Noyve – Copyright Contact

Email: support@noyve.com

Address: 8 Haviland St Apt D, Norwalk, CT 06854-3026, United States

Recommended email subject:

Also identify the location where the material appeared before it was removed or disabled.

C. Statement Under Penalty of Perjury

D. Name and Contact Information

Provide:

F. Acceptance of Service

Include a statement agreeing to accept service of process from:

  • The person who submitted the original copyright notice; or
  • That person's authorized agent.

Address:

[Full mailing address]

Telephone:

[Telephone number]

Email:

[Email address]

Material Removed:

[Description of material]

Previous Location:

[URL where the material appeared]

Statement of Good Faith:

“I state under penalty of perjury that I have a good-faith belief that the material identified above was removed or disabled as a result of mistake or misidentification.”

Jurisdiction and Service Statement:

“I consent to the jurisdiction of the Federal District Court for the judicial district in which my address is located, or, if my address is outside the United States, the appropriate federal judicial district as provided under applicable law, and I will accept service of process from the person who submitted the original infringement notification or that person's agent.”

Physical or Electronic Signature:

[Name / Signature]

16. Processing a Counter-Notification

When a sufficiently complete counter-notification is received, we may provide a copy to the party who submitted the original copyright infringement notice.

Where the applicable statutory process applies, the removed material may be restored after the legally prescribed period unless the original claimant notifies us that legal action has been filed seeking a court order to restrain the allegedly infringing activity.

17. Restoration Period

Where the statutory counter-notification process applies, material may generally be restored not less than 10 and not more than 14 business days after receipt of a valid counter-notification unless the original complaining party provides notice that an appropriate court action has been filed seeking to restrain the allegedly infringing activity.

Restoration is subject to applicable law and the circumstances of the individual case.

18. Court Proceedings

If the original copyright claimant notifies us that a lawsuit has been filed seeking a court order concerning the disputed material, we may keep the material removed or disabled while the legal dispute is pending.

Noyve does not determine complex copyright ownership disputes that properly require resolution by a court or other competent authority.

19. False or Misleading Copyright Notices

Copyright notices must be submitted accurately and in good faith.

Do not knowingly misrepresent:

  • Copyright ownership.
  • Authorization to act for a rights owner.
  • Whether material is infringing.
  • Whether particular use is unauthorized.

Knowingly making material misrepresentations in a copyright infringement notice may result in liability under applicable law.

20. False or Misleading Counter-Notifications

Counter-notifications must also be accurate and submitted in good faith.

Do not submit a counter-notification if you know that:

  • The material was not removed by mistake.
  • You do not have the rights or authorization claimed.
  • Information included in the counter-notification is materially false.

Material misrepresentation in a counter-notification may result in legal consequences.

21. Fair Use and Other Lawful Uses

Not every use of copyrighted material constitutes infringement.

Applicable law may permit certain uses, including circumstances involving:

  • Fair use.
  • Licensing.
  • Permission.
  • Public-domain material.
  • Other legally authorized uses.

Before submitting a copyright infringement notice, claimants should consider whether the disputed use may be authorized by the copyright owner or permitted by applicable law.

22. Copyright Registration

A copyright registration number may be provided as supporting information where available.

However, the absence of a registration number does not automatically prevent a copyright owner or authorized representative from submitting a takedown notice.

Any separate requirements for bringing a copyright infringement lawsuit are governed by applicable law.

23. Repeat Infringer Policy

Where applicable to our services and circumstances, Noyve may take appropriate action concerning parties who repeatedly infringe copyrights.

Depending on the nature of the service and activity, measures may include:

  • Content removal.
  • Product delisting.
  • Access restrictions.
  • Account restrictions.
  • Termination of applicable user privileges.
  • Supplier review.
  • Other reasonable measures.

We may consider the circumstances and available evidence before taking action.

24. Standard Technical Measures

Where applicable, we intend to accommodate and not improperly interfere with qualifying standard technical measures used by copyright owners to identify or protect copyrighted works, as required by applicable law.

25. Product Images

Copyright complaints may concern product images displayed on noyve.com.

If you own the copyright to an image and believe it is being used without authorization, please provide:

  • The original image.
  • Evidence of ownership where reasonably available.
  • Original publication information.
  • Exact Noyve product URL.
  • Identification of the disputed image.

26. Product Descriptions

If you believe written content or a product description on noyve.com copies your copyrighted work without authorization, identify:

  • Your original content.
  • Original publication location.
  • Relevant publication date where available.
  • The specific text at issue.
  • Exact Noyve page URL.

27. Artwork and Clothing Designs

Copyright claims concerning artwork, prints, graphics, or other copyright-protected creative elements incorporated into clothing may be submitted through this procedure.

Please identify:

  • The original protected work.
  • The allegedly infringing product.
  • The specific creative elements at issue.
  • Supporting evidence of ownership.

Copyright protection does not necessarily apply to every functional or design element of a garment, and claims will be evaluated based on the information provided and applicable law.

28. User-Submitted Content

If noyve.com permits customers or other users to submit:

  • Reviews.
  • Images.
  • Comments.
  • Photographs.
  • Other content.

copyright complaints relating to such material may be submitted using this procedure.

Where appropriate, reported user content may be removed or restricted while the claim is reviewed.

29. Supplier or Third-Party Content

Some content associated with products may originate from suppliers, manufacturers, licensors, or other authorized sources.

If a copyright claim concerns such material, we may contact the relevant party to:

  • Confirm authorization.
  • Request supporting records.
  • Investigate the content source.
  • Determine whether removal is appropriate.

30. No Automatic Determination of Infringement

Submitting a DMCA notification does not automatically prove copyright infringement.

Likewise, submitting a counter-notification does not automatically prove that the disputed use is lawful.

Where appropriate, Noyve may follow the applicable notice-and-counter-notice process while leaving final legal determinations to the parties, courts, or other competent authorities.

31. Claim Withdrawal

If you submitted a copyright infringement notice and later wish to withdraw it, contact:

support@noyve.com

Please include:

  • Your name.
  • Original notice information.
  • Affected URL.
  • Clear confirmation that you are withdrawing the claim.

We may verify withdrawal requests before restoring affected material.

32. Information Sharing During a Copyright Dispute

Information contained in a copyright notice or counter-notification may be disclosed to relevant parties where necessary to administer the copyright claim process.

For example, a counter-notification may be provided to the person who submitted the original infringement notice.

By submitting a notice or counter-notification, you acknowledge that relevant information may need to be shared as required by the applicable process or law.

33. Personal Information

Personal information submitted through the copyright reporting process will be handled in accordance with our Privacy Policy and applicable law.
